Pourtant, malgr\u00e9 la mise en place de r\u00e8gles strictes, des situations o\u00f9 les employ\u00e9s ne suivent pas les instructions peuvent survenir. La question qui se pose est simple : <strong>dans quelle mesure l\u2019employeur peut-il \u00eatre tenu responsable<\/strong> si ces consignes ne sont pas respect\u00e9es et qu\u2019un accident survient ?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les obligations l\u00e9gales de l\u2019employeur<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019employeur est tenu par la l\u00e9gislation de <strong>pr\u00e9venir les risques professionnels<\/strong> et de prot\u00e9ger la sant\u00e9 de ses salari\u00e9s. Cela passe par la mise en place de consignes claires, la formation aux proc\u00e9dures de s\u00e9curit\u00e9 et la mise \u00e0 disposition des \u00e9quipements n\u00e9cessaires. Les textes de loi et le Code du travail imposent notamment de :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Identifier les risques li\u00e9s \u00e0 chaque poste,<\/li>\n\n\n\n<li>Mettre en place des mesures de pr\u00e9vention adapt\u00e9es,<\/li>\n\n\n\n<li>Former les salari\u00e9s aux gestes et comportements \u00e0 adopter,<\/li>\n\n\n\n<li>Contr\u00f4ler r\u00e9guli\u00e8rement la bonne application des consignes.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ces obligations cr\u00e9ent un cadre dans lequel l\u2019employeur peut \u00eatre tenu responsable si les r\u00e8gles de s\u00e9curit\u00e9 ne sont pas correctement appliqu\u00e9es.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quand la responsabilit\u00e9 de l\u2019employeur peut \u00eatre engag\u00e9e<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La responsabilit\u00e9 de l\u2019employeur peut \u00eatre engag\u00e9e dans plusieurs situations. <strong>Si l\u2019accident survient parce que les consignes n\u2019ont pas \u00e9t\u00e9 mises \u00e0 disposition ou n\u2019ont pas \u00e9t\u00e9 adapt\u00e9es aux risques<\/strong>, l\u2019employeur peut \u00eatre jug\u00e9 responsable.
