Toutes les entreprises employant au moins un salari\u00e9 ont l\u2019obligation l\u00e9gale de le mettre en place et de le tenir \u00e0 jour.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Au-del\u00e0 de la conformit\u00e9 l\u00e9gale, le DUERP permet de <strong>pr\u00e9venir les accidents et maladies professionnelles<\/strong>, en identifiant les risques pr\u00e9sents dans l\u2019entreprise et en mettant en \u0153uvre des mesures adapt\u00e9es. L\u2019employeur a donc un r\u00f4le actif et responsable dans sa r\u00e9daction et son suivi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Qu\u2019implique r\u00e9ellement la mise en place du DUERP&nbsp;?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La principale mission de l\u2019employeur est de <strong>recenser et analyser tous les risques li\u00e9s \u00e0 l\u2019activit\u00e9<\/strong> : risques physiques, chimiques, psychosociaux, ergonomiques ou li\u00e9s aux \u00e9quipements. Le DUERP doit pr\u00e9senter une vision compl\u00e8te de la situation de l\u2019entreprise et des actions mises en place pour r\u00e9duire ces risques.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il ne s\u2019agit pas seulement de remplir un formulaire : le document doit \u00eatre <strong>pr\u00e9cis, actualis\u00e9 et accessible<\/strong> aux salari\u00e9s et aux instances repr\u00e9sentatives. La loi impose \u00e9galement de le conserver pendant une dur\u00e9e minimale de 40 ans pour certains risques li\u00e9s \u00e0 l\u2019amiante ou \u00e0 des produits dangereux.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La responsabilit\u00e9 de l\u2019employeur dans le suivi des risques<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019employeur ne se limite pas \u00e0 la r\u00e9daction initiale : il doit <strong>assurer le suivi r\u00e9gulier et la mise \u00e0 jour du DUERP<\/strong>. Chaque nouvelle activit\u00e9, changement d\u2019organisation ou incident doit \u00eatre pris en compte pour ajuster les mesures de pr\u00e9vention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le suivi implique \u00e9galement la formation des salari\u00e9s, la sensibilisation aux risques et la v\u00e9rification r\u00e9guli\u00e8re des \u00e9quipements. Une absence de suivi peut exposer l\u2019entreprise \u00e0 des sanctions p\u00e9nales ou civiles en cas d\u2019accident.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les obligations l\u00e9gales en d\u00e9tail<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La loi encadre plusieurs points pr\u00e9cis concernant le DUERP :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019\u00e9valuation des risques doit \u00eatre compl\u00e8te et transversale.<\/li>\n\n\n\n<li>Le document doit \u00eatre tenu \u00e0 jour au moins une fois par an, ou d\u00e8s qu\u2019une situation nouvelle appara\u00eet.<\/li>\n\n\n\n<li>Les salari\u00e9s doivent \u00eatre inform\u00e9s des risques identifi\u00e9s et des mesures mises en place.<\/li>\n\n\n\n<li>Le document doit \u00eatre accessible aux repr\u00e9sentants du personnel et aux autorit\u00e9s de contr\u00f4le.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Cette r\u00e9glementation vise \u00e0 <strong>garantir la transparence et la pr\u00e9vention<\/strong>, et elle s\u2019applique \u00e0 toutes les entreprises, quelle que soit leur taille ou leur secteur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les cons\u00e9quences d\u2019un DUERP incomplet ou inexistant<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ne pas respecter les obligations li\u00e9es au DUERP expose l\u2019entreprise \u00e0 plusieurs risques :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>En cas d\u2019accident, la responsabilit\u00e9 de l\u2019employeur peut \u00eatre engag\u00e9e devant les tribunaux.<\/li>\n\n\n\n<li>Les autorit\u00e9s de contr\u00f4le peuvent infliger des sanctions administratives ou financi\u00e8res.<\/li>\n\n\n\n<li>L\u2019absence de pr\u00e9vention augmente le risque d\u2019incidents graves et de maladies professionnelles, affectant la sant\u00e9 des salari\u00e9s et la continuit\u00e9 de l\u2019activit\u00e9.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ainsi, un DUERP incomplet ou n\u00e9glig\u00e9 peut avoir des <strong>cons\u00e9quences lourdes \u00e0 la fois pour les salari\u00e9s et pour l\u2019entreprise<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les chiffres qui illustrent l\u2019importance du DUERP<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Selon la CNAM, environ <strong>650 000 accidents du travail sont d\u00e9clar\u00e9s chaque ann\u00e9e en France<\/strong>, et une part significative pourrait \u00eatre \u00e9vit\u00e9e gr\u00e2ce \u00e0 une \u00e9valuation rigoureuse des risques.
